D-FLASHER DISCLAIMER AND TERMS OF USE AGREEMENT

IMPORTANT: READ CAREFULLY BEFORE USING THIS APPLICATION

This agreement applies to the use of websites https://www.dflasher.com, use of our social media sites (the "Sites"), D Flasher ("App") once you have downloaded a copy of the App onto your mobile telephone or handheld device ("Device") and any of the services accessible through the App or the Site, email, phone call (the "Services").

By proceeding with the use of D-Flasher (the "Software"), you (the "User") acknowledge and agree to the terms and conditions set forth in this Disclaimer and Terms of Use Agreement. We 2859910 Ontario Inc (the "Company") do not intend to use our products for any illegal purpose whatsoever. By purchasing any of our product(s) you acknowledge and approve the following:

  • You agree that the product(s) will be used exclusively in a lawful manner. If you are in doubt as to the legality of your planned usage you should consult with a lawyer and obtain independent legal advice. You acknowledge that you are solely responsible for complying with all relevant laws in your area.
  • You fully understand and affirm that D Flasher is sold without warranty. Some products sold are not designed for sale or use on street-compliant vehicles or pollution-controlled machines. Products are intended for closed-course off-road competition only in accordance with the Clean Air Act and may never be used on a public road or highway, unless permitted by specific regulatory exemptions.
  • By clicking below, you are certifying that the parts (including software) or equipment you are buying will only be used for lawful purposes and will not be used to defeat OEM emissions control equipment in violation of the U.S. Clean Air Act, or the laws of your area.

Disclaimer of warranties, damages, and limitation of liability

Neither we nor any third parties provide any warranty or guarantee as to the accuracy of the information and materials found or offered within this app. We exclude liability for any such inaccuracies or errors. Use of any information or products within this app is at your own risk, for which we shall not be liable.

Company disclaims any warranties with regards to this application and your purchase of any products hereunder. You expressly acknowledge and agree that use of the licensed application, the materials and services are provided "As Is" and "As Available." Company will not guarantee or make any representations regarding the use of, or the result of the use of, the material in the application in terms of their accuracy or reliability.

Under no circumstance, including but not limited to negligence, shall the Company be liable for any direct, indirect, incidental, consequential, or any other damages whatsoever. The Company shall have no liability or responsibility for any delay in the delivery, installation or use of the products, as well as the service life of the products, performance, applicability for the use intended, proper installation, or the accuracy of information provided.

The use of product modifications and installations are at the customer's own risk. The Company does not guarantee the legality of any software used on street-driven vehicles. It is the customer's responsibility to verify compliance with local laws before purchasing and installing a product. Some items used and/or installed by D Flasher may void portions of your vehicle's factory warranty and Company will not be held liable.

By submitting activation, customer acknowledges they have read and understand this document and agree to be bound by its terms.

Currency

All prices and transactions on this website are listed and processed in United States Dollars (USD), unless otherwise stated. While we operate in Canada, we use USD as our standard currency for consistency and ease of international transactions. Please be aware that exchange rates may vary, and your financial institution may charge additional fees for currency conversion. We are not responsible for any discrepancies or additional charges related to exchange rates or foreign transaction fees.

Returns and Refunds

Returns of unused Licences can be made within 14 days from date of purchase. No returns on shipped adapters. No refunds on shipping and/or duties costs. A restocking fee of 20% applies to all returns. No returns on discounted orders. To start a refund, please email us along with the order number. Please send only one return ticket to avoid delays. Refunds will be issued upon acceptance. Bank processing times and fees may affect refund amount.

Agreement to terms and conditions

By selecting "I Agree" or otherwise proceeding with the use of D-Flasher, you confirm that you:

  • Have read, understood, and agree to all terms outlined in this disclaimer.
  • Accept full responsibility for any actions taken using this software.
  • Understand the legal and mechanical risks involved.

If you do not agree to these terms, exit the application immediately.
